Location: San Jose is the main division of the Santa Clara County Superior Court. The Courthouse, known as the Hall of Justice, is located at 190 West Hedding St., San Jose. Drug cases are held at the downtown Terraine Street Courthouse, 115 Terraine Street, San Jose.
What kinds of cases are handled in San Jose?:
The San Jose Court deals with both misdemeanors and felonies. If the location of the incident for which your arrest was made is in San Jose, Milpitas, Santa Clara, Los Gatos or unincorporated parts of the county in the general area, the case will be handled by the San Jose Superior Court. If your case is a felony matter, and your first appearances are in another part of Santa Clara County, such as Palo Alto, Sunnyvale or Morgan Hill/Gilroy, your case will most likely stay in one of those courts unless it proceeds to jury trial, and it appears that such a trial may last more than two weeks. If your jury trial looks as if it will last more than two weeks, your case may be transferred to San Jose for the jury trial phase. San Jose is the county seat for Santa Clara County. As a result, Cahners & Samuels has decades of experience in dealing with the San Jose court system and the prosecutors and judges that work in that area.
What are your chances for actually going to Jury Trial in your matter?
No one can tell for sure whether any individual case will actually have to proceed to trial, but the actual percentage chance that any case will go to trial is usually quite small. If your case is one of those that must be tried, Cahners & Samuels has over 40 years of combined jury trial experience in the San Jose Courts.
